The Impact of Artificial Intelligence in Intellectual Property

This text addresses the evolution of Artificial Intelligence (AI) in artistic creation and the challenges it poses to intellectual property. It highlights the shift from early rudimentary AI creations, dependent on programmers, to the current ability of AI to create artistic works autonomously. The central problem is the lack of applicability of intellectual property to AI products. Legal, ethical and regulatory issues are discussed, including the contradiction between ordinary property and intellectual property, as well as the financial and labor risks associated with AI. The search for solutions includes initiatives at the World Intellectual Property Organization (WIPO) and the adaptation of patent systems to the AI era. The need for regulations to address the autonomous creation of works by AI is raised and actions to ensure the ethical development of the technology are explored.
